TERMS OF USE FOR MYCARDINFO
Introduction
These Terms of Use are agreed to between CU Cooperative Systems, Inc., d/b/a Co-op Solutions (“Co-op,” “us,” or “we”) and you (“you”). MyCardInfo is an account management service provided to you by your Financial Institution (“FI”, “the FI”). These Terms of Use describe the terms and conditions governing your use of MyCardInfo. MyCardInfo may be used by the primary and/or any joint accountholder to access certain information and services regarding a credit card account with your FI.
Please read these Terms of Use carefully. Your enrollment in, access to, or use of MyCardInfo constitutes your agreement to be bound by all of the terms and conditions of these Terms of Use. If you do not agree to the terms and conditions below, do not access this site, or any pages contained in this site. Unless you have entered into a separate written agreement with Co-op regarding MyCardInfo, these Terms of Use are the complete and exclusive agreement between you and Co-op regarding your access to and use of MyCardInfo and supersedes any oral or written proposal, quote, or other communication between you and Co-op regarding your access to and use of MyCardInfo.

Definitions
Words and phrases used in these Terms of Use have the definitions given in these Terms or, if not defined herein, have their plain English meaning as commonly interpreted in the United States.
Term
These Terms are entered into as of the date you first access or use the MyCardInfo (the “Effective Date”) and will continue until terminated as set forth herein.
Your enrollment in, access to, use of MyCardInfo, or MyCardInfo itself may be terminated or suspended, in whole or in part, at any time for any reason with or without prior notice. Examples of reasons for such termination include, without limitation:
- You have reported your card as lost or stolen;
- Your account has been closed with a zero balance;
- Fraudulent activity has or may have occurred on your credit card account;
- Your account has been reported with a bankruptcy status;
- Any attempt to misuse MyCardInfo; or
- Whole or partial, permanent or temporary, termination of MyCardInfo.
If you wish to cancel your access to MyCardInfo, please contact your FI.
Modification
Co-op reserves the right, at any time, to modify MyCardInfo, as well as these Terms, whether by making those modifications available through the MyCardInfo website or by providing notice to you through your account. We recommend that you visit this page periodically to review the Terms of Use because they are binding on you. Furthermore, your FI may change or limit any aspect of MyCardInfo or these Terms of Use at any time with or without prior notice to you; provided, however, that your FI will provide you with prior notice in the event that fees are assessed for the use of MyCardInfo.
You must cease using MyCardInfo or terminate these Terms of Use at any time if you do not agree to any modification. However, you will be deemed to have agreed to any and all modifications through your continued use of MyCardInfo following such notice. Any modifications to MyCardInfo, including all updates, upgrades, new versions, and new releases, will be treated as part of “MyCardInfo” for purposes of these Terms of Use.
Age Eligibility
MyCardInfo is intended for use by Users of 18 years of age or older. Do not use MyCardInfo if you are under the age of 18, unless your parent or legal guardian has consented to your use of MyCardInfo through your FI.
Accounts
As part of your enrollment for MyCardInfo, you shall receive access to your account with your FI through MyCardInfo, such as through a username, password, and/or personal security code. For your protection, you shall not disclose or transfer any information that provides you with access to your account to anyone, or provide a third party with the right to access log-in credentials. Your FI is authorized to act on instructions received under your account without further verification.
For security purposes, you should memorize and not write down your log-in credentials. You are responsible for keeping your log-in credentials, other identifying information, account numbers and other account data confidential. You are solely responsible for all use of MyCardInfo through your account. Any activities completed through your account will be deemed to have been performed by you. You may not: (1) select or use an account username of another individual with the intent to impersonate that individual; or (2) use an account username that we, in our sole discretion, deem offensive. If you believe that your online username or password may have been lost or stolen, or that someone has transferred or may request a transfer to or from your account or may request a change in your information without your permission, notify your FI immediately.
Use of Information and Materials
All content included on MyCardInfo that we provide, such as text, graphics, logos, images, software, application updates, and other materials (collectively, “Our Content”) is the owned or licensed property of Co-op or its suppliers or licensors and is protected by United States and international copyright, trademark, patent, or other proprietary rights (collectively, “IPR”). Co-op and its suppliers and licensors expressly reserve all IPR in Our Content. You are solely responsible for verifying the accuracy, completeness, and applicability of Our Content and for your use of any of Our Content. Except as set forth in these Terms of Use, you are granted no licenses or rights in or to Our Content, or any IPR therein or related thereto.
The information and materials contained in these pages - and the terms, conditions, and descriptions that appear - are subject to change. Your eligibility for particular products and services is subject to final determination and acceptance by your FI. Subject to your compliance with these Terms of Use, we will permit you to access and use MyCardInfo solely for lawful purposes and only in accordance with these Terms of Use.
By using MyCardInfo, you agree that you will not directly or indirectly use any of Co-op’s Content for any other purpose other than the purposes allowed under these Terms of Use. Unauthorized use of MyCardInfo, or images, text, software or products therein may violate copyright, trademark, and other laws. You will not, and will not permit any third party, to: (a) distribute, sell, resell, lend, loan, lease, license, sublicense, transfer; (b) alter, copy, publish, modify, reproduce, display, publicly perform, distribute, create derivative works; (c) alter, obscure or remove any copyright, trademark or any other notices; or (d) otherwise use any of the Contents of MyCardInfo in any way for any public or commercial purpose.
Fees
We recommend that you check with your FI regarding any fees associated with accessing your account information through MyCardInfo. Any fees applicable in connection with your account, including any associated with accessing your MyCardInfo account, continue to apply, as described under the terms of your Cardholder Agreement or in connection with any specific offer for specific products or services through your FI. You agree that your FI is not responsible for any telephone or other online service provider charges incurred by accessing your account at your FI through MyCardInfo. Note, however, that fees may be assessed by your online service provider. Co-op is not responsible for any such fees assessed by your online service provider.
Your monthly statement from your FI represents your FI’s disclosure to you of applicable account information. Please refer to your statement for important information.
Technology and Marks
MyCardInfo, and the databases, software, hardware and other technology used by or on our behalf to operate MyCardInfo, and the structure, organization, and underlying data, information and software code thereof (collectively, the “Technology”), may constitute valuable trade secrets of Co-op’s. You will not, and will not permit any third party to: (1) access or attempt to access the Technology except as expressly provided in these Terms of Use; (2) use the Technology in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Technology; (3) use automated scripts to collect information from or otherwise interact with the Technology; (4) alter, modify, reproduce, or create derivative works of the Technology; (5) distribute, sell, resell, lend, loan, lease, license, sublicense, or transfer any of your rights to access or use the Technology or otherwise make the Technology available to any third party; (6) reverse engineer, disassemble, decompile, or otherwise attempt to derive the method of operation of the Technology; (7) attempt to circumvent or overcome any technological protection measures intended to restrict access to any portion of the Technology; (8) monitor the availability, performance, or functionality of the Technology; or (9) interfere with the operation or hosting of the Technology.
We use reasonable means to protect the security of MyCardInfo, but you acknowledge that perfect security on the internet is impossible and that, as a result, your content may be exposed in the event of a breach.
We retain all rights, title, and interest, including, without limitation, all IPR in and to the Technology and any additions, improvements, updates, and modifications thereto. You receive no ownership interest in or to the Technology, and you are not granted any right or license to use the Technology itself, apart from your ability to access and use MyCardInfo under these Terms of Use. The Co-op name, logo and all product and service names associated with MyCardInfo are trademarks of Co-op’s and its licensors and providers, and you are granted no right or license to use them.
Warranty
You hereby represent and warrant to us that: (a) you have the legal right and authority to enter into these Terms of Use; (b) these Terms of Use form a binding legal obligation on your behalf; (c) you have the legal right and authority to perform your obligations under these Terms of Use; and (d) your access to, and use of, MyCardInfo and the Content, will comply with all applicable laws, rules, regulations, and third-party rights and will not cause us to violate any applicable laws, rules, regulations, or third-party rights.
Disclaimer
The information and materials contained in this site, including, without limitation, text, graphics, links or other items - are provided “as is,” “as available”. NEITHER YOUR FI NOR Co-op warrantS the operation of the materials, or the accuracy, adequacy or completeness of this information and materials, or that COMMUNICATIONS sent from us are free of malware or other harmful components, and expressly disclaims liability for errors or omissions in this information and materials. Co-op cannot and does not represent or warrant that MyCardInfo will operate error-free, uninterrupted, free from unauthorized access, that MyCardInfo and its server are free of computer viruses or other harmful mechanisms, or otherwise meet your REQUIREMENTS. If your use OF MyCardInfo or RELATED material results in the need for servicing or replacing equipment or data, Co-op is not responsible for those costs. You expressly agree that your use of MYCARDINFO is at your sole risk. No warranty of any kind, implied, express or statutory, including but not limited to the warranties on non-infringement of third party rights, title, merchantability, fitness for a particular purpose and freedom from computer virus, is given in conjunction with the information and materials.
Indemnity
By using MyCardInfo, you hereby agree to indemnify, defend, hold harmless, or otherwise release Co-op and our agents, officers, directors, members, managers, shareholders, affiliates, contractors, users, customers, providers, licensees, successors-in-interest, assigns and employees (“Indemnified Parties”) from any and all claims, suits, demands, actions, losses, liabilities, judgments, settlements, fines, penalties, fees, expenses and costs (including attorneys’ fees and court costs) and damages (actual and consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with: (1) your access to, or use of, MyCardInfo; and (2) your breach of any representation, warranty, or other provision of these Terms of Use. We will provide you with notice of any such indemnifiable claim or allegation, and we will have the right to participate in the defense of any such claim at our expense.
IF YOU ARE A CALIFORNIA RESIDENT, YOU HEREBY WAIVE ANY RIGHTS YOU MAY HAVE UNDER CALIFORNIA CIVIL CODE SECTION 1542, WHICH STATES: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR OR RELEASING PARTY.” YOU AGREE TO RELEASE UNKNOWN CLAIMS AND WAIVE ALL AVAILABLE RIGHTS UNDER CALIFORNIA CIVIL CODE SECTION 1542 OR UNDER ANY OTHER STATUTE OR COMMON LAW PRINCIPLE OF SIMILAR EFFECT. TO THE EXTENT PERMITTED BY LAW, THIS RELEASE COVERS ALL SUCH CLAIMS REGARDLESS OF THE NEGLIGENCE OF CO-OP.
LIMITATION OF LIABILITY
In no event shall Co-op or your FI be liable for any damages whatsoever, including, without limitation, direct or indirect, special, exemplary, punitive, reliance, incidental, or consequential damages, losses or expenses arising in conjunction with your use of MyCardInfo or use thereof or inability to use by any party, or in conjunction with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus, or system failure resulting from the use or inability to use MyCardInfo under any theory of liability, whether based on warranty, contract, tort, or any other legal theory, even if your FI, or representatives thereof, are advised of the possibility of such damages, losses or expenses.
OUR TOTAL CUMULATIVE LIABILITY IN CONNECTION WITH THESE TERMS AND ALL MATERIALS, WHETHER IN CONTRACT OR TORT OR OTHERWISE, WILL NOT EXCEED $100. YOU AGREE THAT WE WOULD NOT ENTER INTO THESE TERMS OF USE WITHOUT THESE LIMITATIONS ON OUR LIABILITY. IN JURISDICTIONS WHERE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES IS NOT PERMITTED, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

MyCardInfo may contain links and interactive functionality interacting with the websites of third parties. Co-op is not responsible for, and has no liability for, the functionality, actions, inactions, settings, privacy policies, terms, or content of any such third-party website. The content, accuracy, opinions expressed, and other links provided by these resources are not investigated, verified, monitored, or endorsed by your FI or Co-op. The links and interactive functionality for third-party websites through MyCardInfo do not constitute an endorsement of such third-party websites. Other websites may link to MyCardInfo with or without our authorization, and we may block any links to or from MyCardInfo in our sole discretion. YOUR USE OF THIRD-PARTY WEBSITES IS AT YOUR OWN RISK.
SUBMISSIONS
All information submitted to your FI via this site shall be deemed and remain the property of your FI and your FI shall be free to use, for any purpose, any ideas, concepts, know-how or techniques contained in information a visitor to this site provides to your FI through this site. Your FI shall not be subject to any obligations of confidentiality regarding submitted information except as agreed by your FI entity having the direct cardholder relationship or as otherwise specifically agreed or required by law.
Additional Terms
I. Electronic messages - As part of MyCardInfo, your FI does not accept e-mail messages from cardholders. In order to facilitate cardholder feedback or inquiries, please contact your FI by using the Contact Us page within the Help & Info menu.
II. Access - You may access your FI account through MyCardInfo seven days a week, 24 hours a day. However, at certain times, some or all of MyCardInfo may not be available due to system maintenance or failure. Your FI is not responsible for your inability to access MyCardInfo, for whatever reason. Account balance and activity information are generally updated daily. However, daily updates may not occur due to system maintenance or failure. Your FI is not responsible for any failure to update information, for whatever reason.
III. Miscellaneous - Your FI may delay enforcing any of its rights under these Terms of Use or in connection with MyCardInfo without losing them. If any provision of these Terms of Use is deemed unenforceable, that provision will be removed to the extent necessary to comply with the law, replaced by a provision that most closely approximates the original intent and economic effect of the original provision to the extent consistent with the law, and the remaining provisions will remain in full force.
IV. Governing Law and Jurisdiction. - These Terms of Use is entered into and will be performed in the state of residence and all questions relating to its validity, interpretation, performance, and enforcement (including, without limitation, provisions concerning limitations of action), shall be governed by and construed in accordance with the internal laws of the State of California, notwithstanding any conflict-of-laws doctrines. You agree to submit to the personal jurisdiction of the courts of the State of California.
